These Terms of Service (“Terms”) govern your access to and use of the websites, hosting, domain, email, SSL and web-design services (the “Services”) provided by WebClub (“WebClub”, “we”, “us” or “our”). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
1. The Services
WebClub provides web hosting, domain registration, business email, SSL certificates and website design and maintenance. Specific features, resources and prices are described on the relevant pages of our website and in your order.
2. Accounts & eligibility
You must be at least the age of majority in your province and able to enter a binding contract. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity under your account.
3. Fees, billing & renewals
Fees are shown at the time of purchase and are billed in advance for the term you select. Unless cancelled, plans renew automatically at the then-current rate. Domain registrations and certain third-party products are non-refundable once registered or issued.
4. Refunds
New hosting and email plans include a 30-day money-back guarantee: if you are not satisfied, contact us within 30 days of your initial purchase for a refund of the hosting/email fees. This guarantee does not cover domain registrations, third-party licences, set-up or design work already performed, or renewals.
5. Acceptable use
Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms. We may suspend or terminate Services that violate it.
6. Service availability
We aim for high availability and take reasonable steps to keep the Services online, including monitoring, backups and a 99.9% uptime target. We may perform scheduled or emergency maintenance. The Services are provided on a commercially reasonable basis and we do not guarantee uninterrupted or error-free operation except where a specific written service-level agreement states otherwise.
7. Your responsibilities
You are responsible for the content you host, for obtaining any rights or consents it requires, for complying with applicable laws, and for keeping your own current backups of important data. We provide backups as a convenience but you should not rely on them as your sole copy.
8. Intellectual property
The WebClub name, branding and website are owned by WebClub. Content and websites you create or upload remain yours. Where we build a website for you, ownership transfers as set out in your project agreement once fully paid.
9. Disclaimers & limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” without warranties of any kind. WebClub is not liable for indirect, incidental or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim is limited to the amount you paid us for the Services in the three (3) months before the claim arose.
10. Suspension & termination
We may suspend or terminate the Services for non-payment, violation of these Terms or the Acceptable Use Policy, or to protect our systems and other customers. You may cancel at any time from your account or by contacting us.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts located in Ontario have exclusive jurisdiction.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with a new “last updated” date. Continued use of the Services after changes take effect means you accept them.
